LEGAL DISCLOSURE FRAMEWORK

Information &
Usage

Granite Notary operates under established state notarial statutes, administrative rules, and digital identity preservation regulations. This Privacy Document governs the mandatory collection, verification, retention, and strict non-commercial processing of personal and transactional information provided by clients, signatories, witnesses, and verified parties.

1. Scope of Mandatory & Voluntary Information Collection

To perform legitimate notarial acts, verify legal capacity, prevent identity fraud, and fulfill statutory recording obligations, Granite Notary collects specific data categories directly from signatories during scheduling, in-person execution, and remote online notarization (RON) sessions:

  • Government Identification Credentials: Full legal name, date of birth, issuing agency, expiration date, and unique credential serial number for credential analysis.
  • Signatory Contact Details: Primary residential/business mailing address, validated electronic mail address, and direct telephone numbers.
  • Documentary Record Data: Title of instrument, type of notarial certificate executed, consideration values, and designated transaction parties.
  • Statutory Biometric & Signature Records: Physical wet-ink signatures, digital biometric signature vectors, and right thumbprint impressions where mandated by state law.
  • Audio-Visual Session Recordings: Complete uninterrupted audiovisual recordings and credential authentication logs for all Remote Online Notarizations (RON).

2. Legitimate Use of Data & Notarial Journal Protocols

Information gathered during notarial engagements is strictly utilized to complete the requested official act, maintain statutory notarial journal entries required by state commissioning authorities, and defend the evidentiary validity of executed instruments in judicial proceedings. Granite Notary never leverages, processes, sells, or monetizes client identity files for commercial advertising, behavioral profiling, or algorithmic analytics.

A2P 10DLC Compliance & Mobile Data Security

Strict Prohibition on SMS & Mobile Information Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties under any circumstances.

SMS consent, phone numbers collected specifically for appointment confirmations, signing reminders, and two-factor identity verification are stored in encrypted, isolated environments and are never distributed, leased, or transmitted to outside aggregators.

3. Strict Third-Party Disclosure Restrictions

Granite Notary holds notarial records in confidential trust. Client records and journal entries are released exclusively under the following statutory exceptions:

  • Direct Signatory Authorization: Written, authenticated inspection requests submitted by the primary signatory or authorized legal counsel.
  • Subpoena & Judicial Orders: Formal court orders, judicial subpoenas, or statutory law enforcement directives requiring evidentiary production.
  • Secretary of State Audits: Mandatory regulatory inspection by the commissioning state authority or notary supervisory bureau.
  • Certified Title & Escrow Delivery: Direct transmission of executed loan packages to verified settlement agents, title underwriters, or retaining lenders.

4. Statutory Retention Periods & Physical Security

Physical notarial journals and digital seals are preserved in locked, tamper-evident vaults and AES-256 encrypted digital repositories for a minimum period of ten (10) years, or the exact period mandated by governing state commission regulations. Upon conclusion of the statutory retention lifespan, physical entries are shredded via certified secure document destruction protocols, and digital session recordings are permanently purged in accordance with NIST SP 800-88 standards.

For formal inquiries regarding notarial record verification or to submit an authorized journal inspection request, contact the commissioned notary officer at [email protected].
